Terms of Service

Last updated: October 27, 2026

Overview

Welcome to Mountainview Motorsports Clearance, an online store operated by Clearbrook Cycles Ltd., doing business as Mountainview Motorsports. Throughout these Terms of Service, “we,” “us” and “our” refer to that business.

We operate this website and its related information, content, tools, products and services collectively referred to as the “Services.” Our store is powered by Shopify.

By accessing our website or placing an order, you agree to these Terms of Service and the policies referenced below. If you do not agree, you should not use the Services.

Nothing in these terms limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection or other laws.

1. Access and account information

You must be at least the age of majority in your province, territory or other jurisdiction of residence, or use the Services with the involvement of a parent or legal guardian.

You agree to provide accurate, current and complete contact, billing, payment and shipping information. You are responsible for keeping your account credentials secure and notifying us if you believe your account has been used without authorization.

2. Products and clearance inventory

We sell clearance powersports parts, accessories and other merchandise. Inventory may include discontinued products, older stock and products with limited remaining quantities.

A clearance price does not, by itself, mean an item is used, defective, final sale or without warranty. Any known condition issues or product-specific restrictions should be identified on the applicable product page.

We aim to provide accurate descriptions, photos, part numbers and availability information. Product appearance may vary slightly because of screen settings or packaging changes. Such differences do not remove your rights if a product is materially different from its description.

We may update listings, discontinue products or limit order quantities, subject to applicable law.

3. Part numbers, fitment and installation

Before ordering, please check the listed OEM or manufacturer part number against your vehicle’s exact model, year, trim and application. Similar-looking parts are not necessarily interchangeable.

If you are unsure about compatibility, contact us before ordering. Any fitment or supersession information we provide is based on the information available to us and the vehicle details supplied.

Incorrect or misleading information in our listing remains our responsibility to address as required by applicable law. These terms do not remove your rights when a product is incorrectly described.

Parts must be installed safely and according to the manufacturer’s instructions. Where appropriate, installation should be completed by a qualified technician. Do not install or use a product that appears damaged, incorrect or unsafe.

4. Orders and resale purchases

Customers, repair shops, dealerships and other businesses may purchase products, including for resale, subject to applicable law.

Purchasing for resale does not automatically qualify an order for wholesale pricing, additional discounts, credit terms or exclusive distribution rights.

When you place an order, you offer to purchase the selected products and authorize payment of the total shown at checkout. We may decline or cancel an order because of unavailable inventory, suspected fraud, a material listing or pricing error, or another lawful reason.

If an order cannot be fulfilled after payment has been collected, we will notify you and refund the amount paid for the cancelled items, including related charges where required.

5. Prices, currency and payment

Unless otherwise stated, prices are displayed in Canadian dollars (CAD).

Applicable taxes and shipping charges are shown at checkout before you complete your purchase. Online clearance prices may differ from prices offered in our physical store.

Prices and promotions may change for future purchases. Promotional offers may have additional conditions disclosed with the offer.

You must be authorized to use the payment method supplied and provide accurate payment information.

6. Errors and availability

We may correct errors in product descriptions, prices, shipping charges, fitment information or availability.

If a material error affects an order you have placed, we will contact you to explain the issue and, where appropriate, offer a corrected purchase option or cancellation and refund. We will not charge an additional amount without your agreement.

7. Shipping and delivery

Our Shipping Policy forms part of these terms.

We generally pick and ship orders within 1–3 business days. Carrier transit time is additional.

We currently offer shipping within Canada. Available delivery options and charges are displayed at checkout. Delivery estimates depend on the destination and service selected and may be affected by carrier delays or other circumstances.

If your shipment is delayed, lost, damaged or delivered incorrectly, contact us so we can investigate and help arrange a resolution. Nothing in these terms transfers responsibility to you in a way that conflicts with applicable law.

8. Free in-store pickup

Free in-store pickup is available for eligible orders at:

Mountainview Motorsports
44160 Yale Road
Chilliwack, BC V2R 3Z9
Canada

Pickup preparation is currently estimated at 2–4 days. Please wait for your pickup-ready notification before coming to the store and bring your order confirmation.

Contact us if you need to arrange for someone else to collect your order.

9. Returns and refunds

Our Return and Refund Policy forms part of these terms.

Subject to that policy, new and unused items may be returned within 30 days of delivery in their original product packaging, including documentation and original tags. There are no restocking fees for returns that meet the policy’s conditions.

Customers are responsible for return shipping when they change their mind or order the incorrect part. Please contact us before returning an item.

If we supplied the wrong item or an item arrived damaged or defective, contact us before returning it so we can help arrange an appropriate resolution.

We do not offer exchanges. Customers may place a new order and return eligible unwanted merchandise through our regular return process.

Installed parts, or parts showing signs of attempted installation, are not eligible for ordinary change-of-mind returns. Any other non-returnable products will be identified on their product pages.

These restrictions do not limit rights or remedies available under applicable law for defective, incorrectly supplied or misdescribed goods.

10. Warranties

Any manufacturer warranty depends on the applicable manufacturer’s terms and the product’s eligibility. Contact us before purchasing if warranty coverage is important to your decision.

We do not promise manufacturer warranty coverage unless it has been confirmed. Clearance pricing does not automatically remove an applicable warranty or statutory right.

Nothing in these terms excludes warranties, conditions or remedies that cannot lawfully be excluded.

11. Intellectual property

Website content, branding and other materials belong to us or their respective owners or licensors.

Manufacturer names, trademarks and part numbers are used to identify products and compatibility. Their use does not transfer ownership of those rights.

You may not reproduce or commercially exploit protected website material without permission from the relevant rights holder, except as permitted by law.

12. Acceptable use

You must not use the Services to commit fraud, violate laws, infringe another person’s rights, submit false information, distribute malware, harass others or interfere with the website’s security or operation.

Automated tools must respect applicable access restrictions and must not bypass security measures or disrupt the Services.

We may restrict access where reasonably necessary to address misuse, security risks or unlawful activity.

13. Reviews and feedback

You are responsible for ensuring that reviews and other content you submit are truthful, lawful and do not infringe another person’s rights.

By submitting a review or feedback for publication, you give us permission to display and reproduce it in connection with our store and its promotion. We may moderate unlawful, abusive, misleading or irrelevant submissions.

14. Third-party services and Shopify

Our store uses Shopify and may offer third-party payment tools, links or other services. Those providers may have their own terms and privacy policies.

Purchases from this store are transactions with Clearbrook Cycles Ltd., doing business as Mountainview Motorsports. Shopify provides the platform and is not the seller of our products.

These terms do not exclude any responsibility that a party has under applicable law.

15. Privacy and communications

Our Privacy Policy explains how personal information is collected, used and disclosed.

We may send communications needed to process and service your orders, including payment, shipping, pickup and refund notifications.

Marketing communications are handled separately in accordance with applicable consent requirements. You may unsubscribe using the instructions in those messages.

16. Website availability and liability

We aim to keep the Services accurate, secure and available, but cannot promise uninterrupted or error-free website operation.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the website. Nothing in these terms excludes liability or remedies that cannot legally be excluded, including applicable rights relating to goods we sell.

17. Governing law

These terms are governed by the laws of British Columbia and the applicable federal laws of Canada, subject to any mandatory protections that apply in your place of residence.

Nothing in this section prevents you from exercising rights or bringing a claim in a forum available to you under applicable law.

18. Changes and severability

We may update these terms for future use of the Services. Updated terms will be posted on this page with a revised date, and notice will be provided where required by law.

Changes will not retrospectively remove rights attached to an existing purchase.

If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
